Revolution is providing this website www.revolution.com (the “Site”), as an information service. By accessing the Site, or using the information, tools, and features located on it, you accept and agree to be bound by these Terms of Use (“Terms”) as they may be amended from time to time. It is your responsibility to be aware of, and to observe, these Terms and all applicable laws and regulations of any relevant jurisdiction. You also represent that you are legally competent in your home jurisdiction to agree to these Terms. Subject to these Terms, you may access, view, use, and display the Site and Site Content on your computer or other Internet-capable device for your own, noncommercial purposes, if you comply fully with these Terms. You may not copy or display for redistribution to third parties any portion of the Site or the Site Content (as defined below) without our prior written permission.

We may terminate, change, restrict, suspend, or discontinue any aspect of the Site, or your access to it, at any time without notice or liability to you. We may also change these Terms at any time without notice or liability to you, so you should check these Terms before you use the Site.

Any reference to “Revolution” refers to various affiliated entities using the Revolution® or Rise of the Rest® name and not a single entity.

No Solicitation or Investment Advice

The purpose of the Site (including any portion of the Site available only to investors) is limited to providing you with general information on our services and philosophy. We do not render or offer to render investment advice through the Site. Nothing on the Site constitutes or forms a part of any offer for sale or subscription of, or any invitation to offer to buy or subscribe for, any securities or other financial instruments, nor should it or any part of it form the basis of, or be relied upon in connection with, any contract or commitment whatsoever. We may only transact business or render investment advice in those jurisdictions where we are appropriately registered or licensed or where we are otherwise excluded or exempted from registration or licensing requirements.

Information on the Site

We make no representations or warranties that any information contained on the Site is accurate or that there has been no change in that information since the date first posted. Certain places on the Site may contain information created and published by institutions or organizations independent of us. We do not endorse, approve, certify, or control these materials. In addition, we do not guarantee or assume responsibility for the accuracy, completeness, efficacy, timeliness, or correct sequencing of information in any material on the Site. Use of that information is voluntary, and you should rely on it only after an independent review of its accuracy, completeness, efficacy, and timeliness. Finally, reference in the Site to any specific commercial product, process, or service by trade name, trademark, service mark, manufacturer, or otherwise does not constitute or imply our endorsement, recommendation, or favoring.

Third-Party Sites

As a convenience to you, we may provide links from the Site to websites operated by other entities, including websites of our portfolio companies and websites that publish blogs written by Revolution personnel. We make no warranty or representation regarding any material or information in websites linked to or from the Site or any of the products or services described or offered for sale on those websites, and we do not endorse or accept any responsibility for the information, material, products, or services offered on those websites. The content published in blogs written by our personnel does not necessarily represent our positions, strategies, or opinions, regardless of whether or not we provide links to these blogs on the Site. Links do not imply that any linked website is authorized to use any trademark, service mark, trade name, logo, or copyrighted property of Revolution or any of our affiliates.

Submissions

If you submit a business plan, pitch deck or similar materials to us through the website or otherwise share such information or materials with us, we cannot agree to obligations of confidentiality, non-use or non-disclosure with regard to such information or materials. By submitting information or materials to us, you or anyone acting on your behalf, agree that any such information or materials will not be considered confidential or proprietary, and that we are free to use it without condition. In no event will we be limited in, or restricted from, the pursuit of any opportunities, either alone or with third parties.

Intellectual Property

As between you and us, we own all rights, title, and interest in and to the Site, all the content (including without limitation all text, audio, photographs, images, renderings, RSS feeds, podcasts, reports, charts, logos, widgets, gadgets, applets, and video), software, code, data and other materials available on the Site (collectively, the “Site Content”), the look and feel, design and organization of the Site, and the compilation of the Site Content. Your use of the Site does not grant to you ownership or title of, in, or to any Site Content or any other part of the Site.

The website and its content contain trademarks, service marks, trade names, logos, and trade dress owned by Revolution LLC and its affiliates (collectively, the “Revolution Marks”). Without limiting the foregoing, Revolution LLC owns or claims rights in the following marks, whether registered or unregistered: REVOLUTION, REVOLUTION GROWTH, REVOLUTION VENTURES, REVOLUTION PLACES, REVOLUTION RESORTS, RISE OF THE REST, RISE OF THE REST REAL ESTATE, CACIQUE, and the distinctive “r” logo. Certain Revolution Marks are registered with the United States Patent and Trademark Office and may also be registered or otherwise protected in other jurisdictions.  

Assumption of Risk and Disclaimer of Warranties

Your use of the Site and Site Content is at your sole risk. Neither we nor any of our directors, officers, employees, agents, or content or service providers warrant that use of the Site will be uninterrupted or error free. In addition, although the information provided to you on the Site is obtained or compiled from sources we believe to be reliable, neither we nor any of our directors, officers, employees, agents, or content or service providers make any warranty as to (i) the results that may be obtained from your use of the Site or Site Content, (ii) the accuracy, currency or completeness of the information on the Site, or (iii) the reliability of any advice, opinion, statement, or other materials displayed on, or distributed through, the Site.

The information, products, and services on the Site are provided on an “AS IS” and “AS AVAILABLE” basis. We hereby disclaim any and all representations, warranties, and conditions, whether express or implied, including without limitation those of noninfringement, merchantability, and fitness for a particular purpose.

Limitation of Damages

In no event, including without limitation negligence, are we, or any of our directors, officers, employees, partners, managers, agents, or content or service providers (collectively, the “Protected Entities”) liable for any direct, indirect, special, incidental, consequential, exemplary, or punitive damages arising from, or directly or indirectly related to, the use of, or the inability to use, the Site or Site Content, your provision of information or content via the Site, lost business or lost sales, even if a Protected Entity has been specifically advised of the possibility of those damages.

Events

Acceptance of Terms.  As used below, the term “Revolution Event” means an event, competition, gathering, promotion, meet-up or the like that is organized or hosted by Revolution or its affiliates in order to promote Revolution or the “Rise of the Rest” platform.  In order to participate or attend a Revolution Event, you must agree to the terms in this section.  If you find that you cannot or will not agree to such terms, please do not attend such Revolution Event.  If you apply or register for any Revolution Event through the Site or another platform, you signal that you have read, understand and agree to these event terms.

Photos/Videos Waiver.  Revolution and its representatives sometimes take photos and videos at Revolution Events, and later use them for promotional purposes.  By participating or attending any Revolution Event, you irrevocably grant Revolution and its licensees, the perpetual, exclusive and unencumbered rights to:

  • record your participation in and appearance at the Revolution Event on videotape, audiotape, film, photograph, or any other medium (the “Recordings”);
  • use your name, likeness, voice, and biographical material in connection with the Recordings and the Revolution Event;
  • use, reproduce, edit, modify, transmit, store, publish, or create derivative works based upon the Recordings, as well as exhibit, broadcast, market, promote, stream, sublicense or distribute such Recording, for editorial, commercial, promotional, or any other purpose, in whole or in part in any form of media, an unlimited number of times, worldwide.

Assumption of risk/release of liability/indemnity.  You (for yourself, your heirs, personal representatives, or assigns, and anyone else who might make a claim on your behalf) hereby release, waive, discharge and convent not to sue Revolution and its respective parent companies, subsidiaries, affiliates, funds, officers, directors, partners, shareholders, members, agents, employees, contractors, vendors, sponsors and volunteers from any and all claims, demands, causes of action, damages, losses or expenses (including court costs and reasonable attorneys’ fees) which may arise out of, result from, or related in any way to your attendance at any Revolution Event, except for any gross negligence or willful misconduct on Revolution’s part.

You further agree to indemnify and hold Revolution, its parents, subsidiaries, affiliates, funds, officers, directors, partners, shareholders, members, agents, employees, contractors and representatives harmless, including costs, liabilities and legal fees, from any claim or demand made by any third party due to, related to, or connected with your attendance or conduct at any Revolution Event.

Administrative Terms

These Terms represent the entire agreement between you and us with regard to the Site. These Terms and our relationship with you are governed by the laws of the District of Columbia, without regard to its conflict-of-law provisions. Any cause of action that may arise under these Terms must be brought in the appropriate court in the District of Columbia, and you submit to the personal and exclusive jurisdiction of the courts located there. Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision. If any provision of these Terms is found to be invalid by a court of competent jurisdiction, the court should endeavor to give effect to the parties’ intentions as reflected in that provision, and the other provisions of these Terms remain in full force and effect.

Privacy Policy

Revolution (“we”,  us”) knows your privacy is important to you, and it is important to us too. This Privacy Policy explains the types of information we collect through www.revolution.com (the “Site”), and our digital or online properties or services that link to this Privacy Policy (such as our social media pages) as well as our marketing activities, and other activities described in this Privacy Policy, how we will use it, and how we share or disclose it. 

Please review this Policy to make sure you understand how any personal information you provide us will be handled by Revolution. We may change this Privacy Policy from time to time. When we do, we will let you know by posting the changed Privacy Policy on this page. In some cases, for example, if we make any significant changes, we may contact you directly about them, such as by sending you an email if we have your email address. Any changes will be effective immediately upon posting to the Site. Any reference to “Revolution” refers to various affiliated entities using the Revolution® or Rise of the Rest® name and not a single entity.

We are located in the United States. If you are a non U.S. user of the Site, your Personal Information may be processed in the country in which it was collected and in other countries, including the United States, where laws regarding processing of Personal Information may be less stringent than the laws in your country.  

What information do we collect on the site?

We collect two general types of information from Site users: (1) information collected automatically concerning your use of the Site and (2) personal information collected from you or third parties that identifies or can be used to identify or contact an individual.

Information Collected Automatically: As is the case with many websites, our Site automatically collects your browser type and IP address when you visit the Site. In addition, we use certain tracking technologies (e.g., cookies, local shared objects, and pixel tags) and website analytics tools to monitor and better understand user behavior on the Site. Data captured may include, for example, the referring page that linked you to the Site, the country from which you are conducting your browsing session, the next website you visit when you leave the Site, and any search terms you have entered on the Site or a referral site. Such data does not identify you personally.

  • Cookies: We may collect information using “cookies.” Cookies are small data files stored on the hard drive of your computer or mobile device by a website. 
  • Pixel tags: We may also use pixel tags (which are also known as web beacons and clear GIFs) on our Site to track the actions of users on our Site. Unlike cookies, which are stored on the hard drive of your computer or mobile device by a website, pixel tags are embedded invisibly on webpages. Pixel tags measure the success of our marketing efforts and compile statistics about usage of the Site, so that we can manage our content more effectively. The information we collect using pixel tags is not linked to our users’ personal information.
  • Local storage technologies, like HTML5, that provide cookie-equivalent functionality but can store larger amounts of data on your device outside of your browser in connection with specific applications. 
  • Web beacons, also known as pixel tags or clear GIFs, which are used to demonstrate that a webpage or email was accessed or opened, or that certain content was viewed or clicked. 

Personal Information: Personal information means information that allows someone to identify or contact you, including, for example, your name, email, address, city and any other non-public information about you that is associated with or linked to your personal information. 

  • Contact information: We may collect your email address and, if you choose to provide, certain other information, such as name, company, and city of residence. 
  • Marketing information: We may collect your preferences for receiving marketing communications from us and details about your engagement with our marketing activities.
  • Communications information based on our exchanges with you, including when you contact us through the Service, communicate with us via email, phone, social media, or otherwise. 
  • Investor and business information: We may also collect names, addresses, or other types of personal information from our investors and business partners to help verify that they are authorized to access the pages of the Site dedicated to them, if any such pages exist. ROTR event-related information: If you apply to a ROTR event (including but not limited to, a pitch competition, bus tour event, summit, conference or other gathering related to the ROTR platform or fund, any of the foregoing being a “ROTR Event”), you may submit personal information in connection with submitting information about your business, including but not limited to your name, email, city of residence or headquarters, and professional or social media profile. If you apply for a ROTR event, we share your information with our third party service provider who administers the application and registration process for us.
  • Other information: We may collect other data not specifically listed here, which we will use as described in this Privacy Policy or as otherwise disclosed at the time of collection.

Personal Data of Children:  We do not knowingly collect or solicit Personal Data from anyone under the age of 18.  If you are under 18, please do not attempt to register on the Site or send any Personal Data about yourself to us.  If we learn that we have collected Personal Data from a child under age 18, we will delete that information as quickly as possible. How do we use your information?

We use your information to understand your Site visits, including the pages you view, information you search for, and the average time spent on the Site, and in the aggregate to better understand our audience and increase the functionality and user-friendliness of the Site.  

We also use your information to:

  • provide the Site;
  • enable security features of the Site;
  • establish and maintain your user profile on the Site;
  • communicate with you about the Site, including by sending service-related announcements, updates, security alerts, and support and administrative messages;
  • understand your needs and interests when visiting our Site;
  • personalize your experience with the Site and related communications; 
  • remember your selections and preferences as you navigate webpages;
  • communicate with you about events in which you participate; and
  • provide support for the Site, and respond to your requests, questions and feedback.

We may use your personal information to send you direct marketing communications and may personalize these messages based on your needs and interests.

We may also use your information to:

  • comply with applicable laws, lawful requests, and legal process, such as to respond to subpoenas, investigations or requests from government authorities;
  • protect our, your or others’ rights, privacy, safety or property (including by making and defending legal claims);

  • enforce the terms and conditions that govern the Site; and

We may create aggregated, de-identified and/or anonymized data from your personal information and other individuals whose personal information we collect. We make personal information into de-identified and/or anonymized data by removing information that makes the data identifiable to you. We may use this aggregated, de-identified and/or anonymized data and share it with third parties for our lawful business purposes, including to analyze and improve the Service and promote our business.  

Sharing with third parties

We may, share your personal information with the following parties, or as otherwise described at the time of collection. 

  • Our affiliates.
  • Third parties who provide services to us (such as hosting, information technology, customer support, email delivery, marketing, consumer research and website analytics).
  • Professional advisors, such as lawyers, auditors, bankers and insurers, where necessary in the course of the professional services that they render to us.
  • Third parties with whom we partner, including parties with whom we co-sponsor events.
  • Authorities and others, as required by law and when we believe in good faith that disclosure is necessary to protect our rights or those of third parties, to protect your safety or the safety of others, to investigate fraud or other illegality, or to comply with a court order or other legal process.
  • In connection with a corporate change affecting us or our affiliates, including without limitation a merger, acquisition, sale of assets, or dissolution transaction or proceeding involving sale, transfer, divestiture, or disclosure of all or a portion of our business or assets. For example, we may need to share certain personal information with prospective counterparties and their advisers.

Security

While we employ a number of controls designed to protect the security and integrity of Personal Information in our care, due to the inherent nature of the Internet as an open global communications vehicle, we cannot guarantee that any information, during transmission through the Internet or while stored on our system or otherwise in our care, will be absolutely safe.

Retention

We retain Personal Information about you for as long as you remain a subscriber to our email marketing list or as necessary to provide the Site to you.   In some cases we retain Information Data for longer, if doing so is necessary to comply with our legal obligations, resolve disputes or collect fees owed, or is otherwise permitted or required by applicable law, rule or regulation. Afterwards, we may retain anonymized and aggregated data.

Links to third-party web sites

Our Site may contain links, banners, widgets, or advertisements that lead to other websites, including personal blogs written or edited by members of our staff. We are not responsible for these other websites or the accuracy thereof, and so their privacy policies (not this Policy) will govern the collection and use of your information on them. We encourage you to read the privacy policies of those websites to understand how your information is treated there.

Information Collected From Other Websites and Do Not Track Policy

Through cookies we place on your browser or device, we may collect information about your online activity after you leave our Site.  Just like any other usage information we collect, this information allows us to improve the Site and customize your online experience, and otherwise as described in this Privacy Policy.  Your browser may offer you a “Do Not Track” option, which allows you to signal to operators of websites and web applications and services (including behavioral advertising services) that you do not wish such operators to track certain of your online activities over time and/or across different websites.  Our Site does not support Do Not Track requests at this time, which means that we collect information about your online activity both while you are using the Site and after you leave our Site.

Your Choices

You may request to change any of your Personal Information in your account by editing your profile within your account or by sending an e-mail to us at media@revolution.com.

You may unsubscribe from newsletters and marketing emails at any time by using the unsubscribe instructions on a link at the bottom of such email, or by sending an e-mail to us at media@revolution.com.

Most browsers let you remove or reject cookies. To do this, follow the instructions in your browser settings. Many browsers accept cookies by default until you change your settings. Please note that if you set your browser to disable cookies, the Service may not work properly. Most browsers and devices allow you to configure your device to prevent images from loading. To do this, follow the instructions in your particular browser or device settings.

Under California’s Shine the Light law (California Civil Code Section 1798.83), California residents may ask companies with whom they have formed a business relationship primarily for personal, family or household purposes to provide the names of third parties to which they have disclosed certain personal information (as defined under the Shine the Light law) during the preceding calendar year for their own direct marketing purposes, and the categories of personal information disclosed. You may send us requests for this information to media@revolution.com. In your request, you must include the statement “Shine the Light Request," and provide your first and last name and mailing address and certify that you are a California resident. We reserve the right to require additional information to confirm your identity and California residency. Please note that we will not accept requests via telephone, mail, or facsimile, and we are not responsible for notices that are not labeled or sent properly, or that do not have complete information.

You may request that we delete your Personal Information by sending an e-mail to us at media@revolution.com.  If we delete any information, it may be deleted from the active database, but could remain in our archives.
